Terms of Service
Effective August 2025
Ordering & Payment
By placing an order through Bournes Digital Marketing (BDM), you agree to the terms outlined in this agreement. Orders are initiated by submitting the official Get Started form, which serves as a formal request for services.
BDM is a youth-led digital service, not a registered company. All payments are made directly to Jaaziel Bournes, the founder and operator of BDM. This structure reflects our commitment to transparency and accessibility, especially for startups and small businesses.
All pricing is clearly displayed and automatically calculated based on your selected options. Payment is required in full before work begins, unless a written exception has been approved. Once payment is received, your project is added to our active queue.
If paying via Cash App, you must follow all instructions provided — including using your full legal name and including it in the payment note. Failure to follow these instructions may result in us being unable to verify your payment. In such cases, BDM is not responsible for locating unidentifiable payments, and all sales remain final.
BDM reserves the right to decline any order that conflicts with our values, violates platform policies, or exceeds current capacity.
Due to the custom nature of our services, all sales are final. Refunds are only considered in cases where a critical error prevents delivery. If you have questions before ordering, we encourage you to reach out — our goal is clarity, not confusion.
Project Scope & Revisions
These terms apply to all services offered under both Bournes Digital Marketing (BDM) and Actual Flyers. Both are operated by Jaaziel Bournes, and all payments, deliverables, and communications are directly tied to him. BDM is a service name — not a registered company — and reflects the digital branding and design side of Jaaziel’s work.
Each project is custom-built based on the selections you make in the Get Started form. Your order defines the scope — including deliverables, turnaround time, and included revision rounds.
Revisions are meant to refine, not redesign. If your requested changes go beyond the original scope — such as adding new pages, switching platforms, or requesting a full rebrand — additional charges will apply. These add-ons are clearly listed and can be requested at any time.
Both BDM and Actual Flyers offer a set number of revision rounds depending on your selected package. Unused revisions do not roll over. If you need more than what’s included, you can purchase extra rounds at the listed rate.
We work fast, but we also work smart. Clear communication and timely feedback help us deliver your vision without delays. If you’re unsure what’s included, just ask — we’d rather clarify than disappoint.
Payments & Refunds
All payments are made directly to Jaaziel Bournes, the sole operator of Bournes Digital Marketing and Actual Flyers. These are service names, not registered companies, and Jaaziel is a minor working within the legal limits of youth entrepreneurship. By placing an order, you acknowledge that you are entering into a direct agreement with him.
Payment is due upfront unless otherwise agreed in writing. Your total cost is calculated based on your selections in the Get Started form, including any add-ons or taxes. You’ll receive a clear breakdown before payment is requested.
We accept payments via Cash app. If you need an invoice or receipt, just ask — we keep everything documented.
Refunds are not guaranteed. Because every project is custom-built and time-intensive, we do not offer automatic refunds once work has begun. If you cancel before any work starts, you may be eligible for a partial refund, minus any processing fees. If you’re unhappy with the result, we’ll do our best to fix it — but refunds are handled case-by-case and at Jaaziel’s discretion.
Chargebacks or payment disputes without prior communication will result in a permanent ban from future services. We’re here to help — just reach out if something’s off.
Communication & Deadlines
All communication is handled directly by Jaaziel Bournes, unless otherwise stated. If you have a personal connection, you may reach out via email or DM — but all project details must still be confirmed through the official form or written agreement.
In some cases, work may be delegated to a trusted helper or AI assistant, especially for repetitive tasks or technical support. If that happens, you’ll be notified, and Jaaziel will still oversee the final result.
Deadlines begin once payment is received and all required materials are submitted. If you delay sending content — like text, images, or login access — your timeline will shift accordingly.
If you go silent for more than 7 days without notice, your project may be paused or closed. We’ll send a reminder first, but ghosting wastes time and blocks other clients. If you return later, a restart fee may apply.
Clear instructions are essential. Vague feedback like “make it pop” or “I’ll know it when I see it” slows things down. We’ll ask follow-up questions to clarify, but the more specific you are, the smoother the process.
Image quality matters. If you’re providing a logo or photos, they must be high-resolution and free of watermarks. Low-quality files may affect your final design, and we’re not responsible for pixelation or distortion caused by poor assets.
We communicate primarily via email (info@bournesgroup.com). If you need a phone call or video chat, that must be scheduled in advance and may be limited depending on availability.
Ownership & Usage Rights
All designs, websites, flyers, and digital assets created by Jaaziel Bournes under Bournes Digital Marketing (BDM) or Actual Flyers remain his intellectual property until full payment is received. Once paid in full, you receive the rights to use the final deliverables for personal or business purposes as outlined in your order.
You do not own the original source files (e.g., PSDs, design templates, backend code) unless explicitly purchased as an add-on. We retain the right to showcase completed work in portfolios, social media, or promotional materials — unless you request privacy in writing.
You may not resell, redistribute, or claim authorship of Jaaziel’s work. If you modify the design later, please credit the original creator when possible. Respect goes both ways.
By submitting content (logos, photos, text), you confirm that you have the legal right to use it. We’re not responsible for copyright issues caused by client-provided materials.
Because Jaaziel is a minor, all agreements are made with full transparency. You’re entering into a direct service arrangement with him, not a registered company. These terms are designed to protect both parties and ensure fairness.
